Privacy Policy

1. Who We Are

DesignsByMoonstruck (“we,” “us,” “our”) operates the website designsbymoonstruck.com (the “Site”), through which we showcase and sell digital printable products, and at our Etsy shop designsbymoonstruck.etsy.com and bitofmoondust.etsy.com.

2. Scope of This Policy

This policy explains what personal information we collect through the Site, how we use it, who we share it with, and the choices and rights you have. It applies to visitors and customers of designsbymoonstruck.com. It does not apply to information collected by Etsy when you shop on our Etsy storefront — that’s governed by Etsy’s own Privacy Policy.

3. Information We Collect

Information you give us directly

  • Contact form submissions: name, email address, and message content, if you contact us through the Site.
  • Email sign-up (coming soon): if you choose to join our email list, we’ll collect your email address and, optionally, your name. 
  • Order information, if you purchase directly through the Site rather than through Etsy: name, shipping/billing address, email, and payment details. Payment card numbers themselves are handled by our payment processor (see Section 6) — we do not store full card numbers. 

Information collected automatically

When you visit the Site, we (and the third-party tools listed below) automatically collect certain information about your device and how you use the Site, including:

  • IP address and approximate location (city/region-level, derived from IP)
  • Browser type and version, device type, and operating system
  • Pages viewed, time spent on pages, referring/exit pages, and click activity
  • Date and time of visit

4. Cookies and Tracking Technologies

We use cookies and similar technologies (like tracking pixels) to run the Site and to understand and improve how visitors use it. Specifically, we currently use:

You can control cookies through your browser settings, and you can opt out of interest-based advertising generally through the Digital Advertising Alliance’s opt-out page or the Network Advertising Initiative’s opt-out page.

Important: if any of your visitors are in the EU/UK, GDPR generally requires you to get opt-in consent before running non-essential cookies like Analytics, Pinterest, and Ads pixels — not just disclose them here. A policy page alone doesn’t satisfy that requirement. Consider adding a cookie-consent banner tool (e.g., Termly, CookieYes, Iubenda, or Cookiebot) that blocks these scripts until a visitor consents. Many have a free tier for small sites.

5. How We Use Your Information

We use the information we collect to:

  • Fulfill and manage orders placed directly through the Site
  • Respond to inquiries sent through our contact form
  • Understand how visitors use the Site so we can improve it
  • Measure and improve the performance of our advertising (Pinterest, Google Ads)
  • Send you marketing emails, but only if you’ve opted in to our email list (see Section 7)
  • Comply with legal obligations and protect against fraud or misuse of the Site

We do not use automated decision-making or profiling that produces legal or similarly significant effects on you.

6. Third-Party Service Providers

We share information with the following categories of service providers, who process it on our behalf or for their own analytics/advertising purposes as disclosed above:

  • Analytics & advertising: Google (Analytics, Ads), Pinterest
  • Payment processing Paypal— they collect and process your payment details directly according to their own privacy policy. Remove if not applicable.
  • Website hosting/platform: Wordpress at Bluehost.com
  • Email marketing platform: TBD

We do not sell your personal information to third parties, and we do not share it with third parties for their own independent marketing purposes beyond the advertising/analytics tools listed above.

7. Email Marketing

We do not currently operate an email marketing list. If we launch one in the future:

  • We will only add you to the list if you affirmatively opt in (for example, by submitting a sign-up form).
  • Every marketing email will include a clear way to unsubscribe.
  • We will not sell or rent your email address to third parties.
  • We will handle your email consistent with the CAN-SPAM Act and, for subscribers in the EU/UK, applicable consent requirements under GDPR/UK GDPR.

8. Your Privacy Rights

If you are in the United States

Depending on your state of residence (for example, California, Colorado, Connecticut, Virginia, or others with consumer privacy laws), you may have rights to know what personal information we’ve collected about you, request deletion of it, correct it, or opt out of certain uses such as targeted advertising. To exercise any of these rights, contact us at hello@designsbymoonstruck.comSome of these state laws only apply to businesses above certain revenue or data-volume thresholds — worth checking with a lawyer whether you currently fall under them, but it’s reasonable (and good practice) to honor these rights either way.

If you are in the EU/UK

If you are located in the European Economic Area or the United Kingdom, you have rights under the GDPR/UK GDPR, including the right to:

  • Access the personal information we hold about you
  • Request correction or deletion of it
  • Restrict or object to our processing of it
  • Receive a copy of it in a portable format
  • Withdraw consent at any time (for anything we process based on consent, like marketing emails or non-essential cookies)
  • Lodge a complaint with your local data protection authority

Our legal basis for processing is generally: performance of a contract (fulfilling your order), legitimate interests (running and improving the Site, basic security), and consent (marketing emails, non-essential cookies/tracking).

9. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this policy — for example, order records for accounting and legal purposes, and contact form messages until your inquiry is resolved — after which we delete or anonymize it, unless a longer retention period is required by law.

10. Children’s Privacy

The Site is not directed to children under 13 (or 16 in the EU/UK), and we do not knowingly collect personal information from children in that age range. If you believe a child has provided us with personal information, please contact us at hello@designsbymoonstruck.com and we will delete it.

11. Data Security

We use reasonable administrative and technical safeguards to protect the personal information we collect. However, no method of transmission or storage is 100% secure, and we can’t guarantee absolute security.

12. International Data Transfers

Because we serve customers worldwide, information we collect may be transferred to, stored, and processed in the United States or other countries where our service providers (like Google) operate, which may have different data protection laws than your home country.

13. Links to Other Sites

The Site may link to other websites, including our Etsy shop. We are not responsible for the privacy practices of those sites, and we encourage you to review their privacy policies separately.

14. Changes to This Policy

We may update this policy from time to time. We’ll post the revised version here with an updated effective date at the top. Significant changes will be noted more prominently if required by law.
